  1. Use, extent and purpose of storage and processing

We store and process personal data for the purposes of logging in to the service (account) of maintaining contact with customers, marketing information via e-mail, sales promotion, customer profiling with the aim of tailoring content and products to customers in e-mail and websites. ​ The manager is obliged by law to issue an invoice to the individual for each purchased service. The invoice contains the following personal data:

  • name and surname of the Individual;
  • address of residence
  • tax number;
  • the number, date, and place of issue of the invoice;
  • purchased services and their prices;
  • total value (amount) of the purchase (order);
  • the rate and amount of value-added tax (VAT).

The controller keeps the stated personal data (invoices) for 10 years from the date of issue. ​ We keep it for the purpose of notification by e-mail

We collect personal data with express consent or. consent of individuals. Consents are kept together with their contents and the contents of the form with which they were obtained. ​ Personal information is used by our following sections:

​ We use an external service (Wix.com) to send news, in accordance with their rules. The email address list is stored in the cloud and is used specifically for our messages, but in no way for any other purpose. ​

We keep personal data collections in the territory of the Republic of Slovenia and do not export them to other countries. ​

We keep the individual’s personal data until the revocation of the consent for the storage and processing of the individual’s data. Upon revocation of an individual’s consent, his or her personal data shall be deleted immediately, efficiently, and permanently. Should the purposes described above, for which we store and process personal data, cease to exist in our company, we will immediately and effectively delete the databases whose purpose has ceased. ​

  1. GENERAL PROVISIONS

These general terms and conditions are an integral part of the contract concluded between Nika Špika-Nika Šuligoj SP and (hereinafter Nika Špika) and the client / guest who applies for the service organized by Nika Špika. In the event that an individual provision in the program is regulated differently than in these general terms and conditions, the provisions in the program shall apply. ​ In the case of telephone sales or sales via the Internet, it is considered that the subscriber / guest has accepted the provisions of these general terms and conditions when he ordered services by telephone or via the Internet. The client / guest can get acquainted with the provisions of the general conditions on the website http://www.nikaspika.si, where they are specially marked and generally accessible. ​ The client or subscriber / guest is any person who has made a valid reservation or made a purchase / payment for services. ​ These general terms and conditions do not apply to the rental of cars and other equipment of service providers, where he represents Niko Špika as an intermediary. In this case, the client / guest is bound by the general conditions of providers and legislation in this area.

  1. REGISTRATION AND CONTRACT

The client / guest can register for the service organized by Nika Špika at Nika Špika. The service program is considered an offer. Based on the offer, the client / guest registers in writing or orally for the selected service. Upon check-in, the client / guest receives a document from Nik Špik (invoice, which is a service contract), which shows all the information about the ordered tourist service. The client / guest is obliged to review the document and in case of any disagreement or error to advertise it within one day after its issuance or before the performance of services. With the payment of the first installment (advance payment), the contract is considered concluded. Upon registration, the client / guest is obliged to provide the required information and submit the documents required by the service program and make the payment in accordance with the provisions of these general terms and conditions. In the event that the client / guest does not provide the correct information at check-in, he is responsible for all costs or consequences incurred due to incorrect information. The registration of the client / guest is binding. He may withdraw from it in accordance with the provisions on cancellation of the services of the client / guest. In addition to the paid 1st installment of the invoice, the application with the application form is also considered a binding application. By filling in the application form or submitting the personal data of the subscribers / guests, it is considered that the contract has been concluded and the subscriber / guest is obliged to pay all costs in accordance with the provisions on cancellation of services by the client / guest. ​ In accordance with the contract, Nika Špika is obliged to provide the client / guest with services that have the content and characteristics as announced in the contract or service program and to take care of the rights and interests of the client / guest in accordance with good business practices. ​ The client / guest is obliged to ensure that he personally, his personal documents and his luggage meet the conditions prescribed by border, customs, sanitary, monetary and other administrative regulations. Nika Špika has the right to reject the application of the client / guest, for whom he can justifiably assume in advance that he does not meet these conditions or could not meet them during the provision of services. III. REGISTRATION FEE AND SECURITY For its services, Nika Špika charges the client standard reservation costs and costs for compiling an offer in the amount of € 100. Nika Špika may set different booking costs for each service. In the case of personalized services and offers, Nika Špika may charge the client / guest EUR 30.00 in the form of a security for the preparation of the offer. If the client / guest does not accept the offer, the security will not be refunded.

  1. PAYMENT

The day of payment is considered to be the day when the client / guest makes the payment directly to Nika Špika, or when Nika Špika receives the payment on the transaction account. The client / guest or group pays a € 100 advance payment upon registration. The client / guest pays the remaining part at least 10 days before the start of the trip, unless otherwise stated in the document of Niko Špik (contract, invoice). Timely payment means a confirmed reservation. If the client / guest does not pay within the agreed deadline, this means the cancellation of services and the provisions on the cancellation of the services of the client / guest apply mutatis mutandis. The client / guest undertakes to pay the difference that would arise due to a possible calculation error on the issued document of Nik Špik, and Nika Špik undertakes to return to the client / guest any overcharged amount arising from the calculation error. This obligation is valid until the end of the financial year. Nika Špika may stipulate in the program that the client / guest pays for certain services that will be performed on the spot, to her representative (“mandatory additional payment on the spot”). In this case, Niko Špik does not act as an organizer or a mediator, but only as an informant. In this case, the client / guest asserts all claims exclusively from the service provider on the spot.

  1. PRICES

The prices of services are determined by the program and are valid from the day of publication of the program until the change. The price includes the services listed in the service program. For the client / guest, the valid price is on the day of concluding the contract / issuing the invoice. ​ In accordance with the applicable legislation, Nika Špika may change this price even after the conclusion of the contract, due to changes in the exchange rate or due to changes in the tariffs of carriers that affect the price of services. In the event of a change in the price from this title, Niko Špik notifies the client / guest in writing no later than 2 days before departure, and issues an additional document (invoice), which the client / guest is obliged to pay before the start of services. ​ If the increase in the agreed price exceeds 8 percent of the price of the tourist service, the consumer can withdraw from the contract without having to reimburse the damage. In this case, Nika Špika will return the amount paid to the client / guest. Also, in the service program, Nika Špika determines the starting price for a certain number of subscribers / guests, which can be changed if a smaller number of subscribers / guests register for the service. In the program, Nika Špika states this additional price in the form of “mandatory surcharge in case of group size from / to persons”. Upon registration, Niko Špik charges the client / guest the starting price of the trip. If the conditions for changing the price due to the “small group” occur, the client / guest cannot withdraw from the contract, as he was acquainted with them at check-in.

  1. SPECIAL SERVICES

Special services are those services that are generally not included in the price of services (special meals, other surcharges if desired…) or for which surcharges are provided in the program (other surcharges, etc.), so the client / guest pays for them separately, unless otherwise specified in the program. ​ In the event that special services are advertised for an individual service, the client / guest submits wishes for these services upon registration, and pays them to the price. The published prices of special services are valid only in the case of ordering and paying for these services upon registration for the service. During the service, the client / guest pays extra for special services to the guide or representative of Niko Špik in the place where the service is performed, if it is still possible to order during the service, at the price valid on the spot. VII. CLIENT / GUEST CHANGE OF CONTRACT OR CANCELLATION OF SERVICES The client / guest has the right to request a change in the contract (eg change of name, additional services, etc.) after its conclusion, and Nika Špika is obliged to check if this is even possible. In the event of a change in the contract at the request of the client / guest Nika Špika may charge the client / guest administrative costs in the amount of 30.00 EUR for the change, unless otherwise specified in these general terms and conditions. In the event that the change incurs additional costs, the client / guest is obliged to pay them. The client / guest has the right to cancel the services directly with Niko Špik. In the event that the client / guest cancels the service, Nika Špika has the right to reimbursement of costs that depend on the time remaining until the start of the service. ​ In any case, Nika Špika charges the client / guest an advance payment in the amount of EUR 100.00. Unless otherwise specified in the program, the following cancellation fees apply: For one-day tourist services:

  • cancellation up to 30 days before the start of the service, 10% of the price,
  • cancellation from 29 to 22 days before the start of the service, 20% of the price,
  • cancellation 21 to 15 days before the start of the service, 30% of the price,
  • cancellation 14 to 8 days before the start of the service, 50% of the price,
  • cancellation 7 days to the day of the service, 100% of the price.

​ Irrespective of the costs of cancellation determined above, they may be different when this is dictated by the conditions of organizing services, ie which are dictated by Nika Špika’s current sales conditions and / or are conditioned by business partners. ​ Notwithstanding the costs set out above, the costs of cancellation may also be different if they are stated in the service program or contract. ​ Upon cancellation of services before departure, the client / guest gives a written notice or signs a notice document issued to him by Nika Špika. If the client / guest refuses to sign or confirm this document, it is considered that the trip has not been canceled. During the service, the client / guest can terminate the service at their request. If the subscriber / guest terminates the service, he is not entitled to a refund or purchase price upon return, neither in part nor in full. If the client / guest changes the program, which is an integral part of the contract with Niko Špik, during the service, it is considered that the client / guest has withdrawn from the contract during the service. In this case, the client / guest is responsible for the costs and damage caused by this. In the event of a change of the program at one’s own request or due to force majeure, without any reasons on the part of Niko Špik due to improperly performed service, the client / guest has no right to demand any compensation or price reduction. ​ Nika Špika or an authorized person may at any time before the service or on the day of departure reject the person when he assesses that the client / guest could endanger the health or property of himself or others, or who is obviously under the influence of alcohol, drugs or other such substances. In this case, Nika Špika follows the provisions on cancellation of the client / guest. ​ During the service, Nika Špika has the right to request from the client / guest to terminate the joint trip with the group, if he does not make sure that he personally, his personal documents and his luggage meet the conditions prescribed by border, customs, sanitary, monetary and other regulations, or if he is obviously under the influence of alcohol, drugs or other such substances or if he behaves inappropriately towards other clients / guests and his exclusion is requested by the group. In this case, Nika Špika follows the provisions on cancellation of the client / guest. Nika Špika will claim all the damage he caused by his inappropriate conduct during the duration of the services. ​ The amount of costs of cancellation of services in the event that Nika Špika is not the organizer of the service is determined by the general terms and conditions or another act of the organizer. VIII. ORGANIZER’S CHANGE OF PROGRAM OR CANCELLATION OF SERVICES In accordance with the applicable legislation, Nika Špika reserves the right to cancel the services if the minimum required number of subscribers / guests specified in the program is not registered for the service. ​ Nika Špika informs the client / guest about the withdrawal of the contract, if the minimum number of subscribers / guests has not registered, no later than: – 2 days (48 hours) before the start of the service, which lasts 1 day. ​ In cases where Nika Špika explicitly guarantees the implementation in writing, he cannot cancel the service, unless less than the minimum number of subscribers / guests provided in the program is registered. ​ Nika Špika reserves the right to withdraw from the contract in full or in part if extraordinary circumstances occur before or during the implementation of the program that could not be expected, removed or avoided, and for Nika Špik these circumstances constitute a valid reason not to would have concluded if they had existed at the time of the conclusion of the contract. ​ Nika Špika may terminate the contract or withdraw from the contract and demand compensation from the client / guest who directly violates the provisions of the contract concluded with Nika Špika, especially if it is established that the client / guest intentionally provided incorrect information about the number of subscribers / guests or their age, or there were changes during the service, but the client / guest did not inform Niko Špik. Nika Špika reserves the right (and is not responsible) for changes in the day and time of departure or for cancellation of the service due to force majeure and the right to change the service if the conditions for the service change (new timetable, precarious situation in the country where the service is organized , natural disasters or other unforeseen causes beyond the control of Niko Špik), without special compensation and in accordance with the applicable regulations in passenger traffic. ​ Nik Špik’s liability is limited only to the non-implementation of a certain part of the program, in the part that means appropriate material costs. Nika Špika is not liable for non-pecuniary damage resulting from delays, cancellations or changes in transport or means of transport. ​ Nika Špika cannot take responsibility for changes to the program due to the occurrence of any force majeure during the course of the program. In these cases, it can provide services to clients / guests in a modified form, depending on the existing options. ​ In the event that Nika Špika cancels the service, the client / guest has the right to a full refund of the price paid, but is not entitled to a refund of the costs required by the program. He immediately informs the client / guest about any subsequent change of Niko Špik’s program.

  1. TRAVEL DOCUMENTS

The client / guest must have a valid passport or other valid document with which he can enter the country. The client / guest is obliged to pay attention to all provisions regarding the validity of the travel document. The validity of the document is taken into account on the LAST day of services! Nika Špika is not responsible for any inconveniences or forced interruptions of the client’s / guest’s trip in this regard. ​ The client / guest is obliged to obtain the visas required for the country. If the client / guest does not fulfill this obligation, Nika Špika will act in accordance with the provisions on cancellation of services with the client / guest. In case of refusal of entry into the country or other obstacles, all costs are borne by the client / guest himself. ​ Due to the requirements in international passenger transport (air, ship, bus…), the client / guest is obliged to provide all the necessary information about all participants who register. The information must fully correspond to the information in official documents that service participants carry with them in accordance with the regulations on crossing the state border and relevant foreign legislative acts. In the event that incorrect information causes a delay, additional costs or interruption of services to other participants, the client / guest is responsible for all costs incurred by the participants. ​ If the client / guest loses documents during the service or they are stolen, but they are absolutely necessary to continue the service or to return home, the client / guest obtains new ones at his own expense. In the event that the client / guest has to terminate the service due to loss or theft of documents, he is not entitled to any refund of the paid price of services or reimbursement of costs.

  1. HEALTH REGULATIONS

Nika Špika is not responsible for any complications or interruptions of services due to non-compliance by the client / guest with the health regulations of the country he enters, as well as for the costs associated with it.

  1. CUSTOMS AND FOREIGN EXCHANGE REGULATIONS

The client / guest is obliged to comply with all customs and foreign exchange regulations of the Republic of Slovenia, as well as the regulations of all other countries of service. If, due to non-compliance with the regulations, the client / guest would not be able to continue, he shall bear all consequences and costs incurred in this regard to him and all other subscribers / guests. XII. LUGGAGE Nika Špika is not responsible for the transport, theft or damage of the client’s / guest’s luggage or other personal belongings, valuables and documents from accommodation facilities (hotel rooms, apartments, etc.) and means of transport (airplanes, buses, ships, etc.). The client / guest addresses the report of lost or damaged luggage to the carrier or hotel. The transport of special luggage (such as bicycles, surfboards, golf equipment, skis, musical instruments, etc.) must be announced by the client / guest upon check-in and paid to the carrier in accordance with the carrier’s rules, unless otherwise specified in the service program. All costs or damage that would result from this are borne by the client / guest himself. ​ During transport, the client / guest has the right to free transport of a certain weight of luggage (according to the carrier), and each additional kilogram is paid by the client / guest on the spot in the appropriate currency or according to the carrier. XIII. INFORMATION The information that the client / guest receives does not bind Niko Špik more than the information in the program or offer. In case of doubt, a written offer, invoice and contract, written information or written explanation is always considered valid. XIV. COMPLAINTS OR COMPLAINTS The client / guest is obliged to report the irregularities to the representative of Niko Špik on the spot when they occur. In the event that the complaint could be resolved on the spot (for example, a poorly prepared dish), the client / guest did not report an error or. irregularities to the representative of Niko Špik, it is considered that the client / guest agreed with such a service and thus lost the right to file subsequent complaints. The client / guest can file a written complaint within one month from the day when the service was performed incorrectly, otherwise Niko Špik does not deal with it in terms of content. The complaint must be substantiated. The client / guest should therefore attach to the complaint the relevant evidence and / or the relevant certificate from the client / caterer, carrier or other relevant person on the factual situation on the basis of which the client / guest asserts his claim. ​ Nika Špika is obliged to respond in writing to the complaint within 8 days of receiving it. If it is a simple defect and the error is not disputable (or if the client / guest did not attach all the necessary documents within the time required to obtain them), Nika Špika is obliged to satisfy the request after receiving a complete complaint. If the mistake is not simple, Nika Špika is obliged to investigate all the circumstances that led to the complaint. Until Nika Špika decides on the appeal, the client / guest waives the intervention of any other person, judicial institutions or the provision of information to the media. ​ The amount of compensation is limited by the amount of the price of the paid service or by the amount of the real value of non-performed services. This provision does not apply in the event that Nika Špika has the right to cancel the services or change the program, in accordance with the provisions of these general terms and conditions and the law. ​ Irrespective of the submitted complaint, the client / guest is obliged to settle his obligations according to the invoices issued for the service provided in accordance with the payment schedule, and any compensation is paid after the complaint procedure to the client / guest’s personal account.

  1. RESPONSIBILITY FOR THE ACCURACY OF AIR CARRIERS

Nika Špika is not responsible for the punctuality of air services on scheduled or non-scheduled flights, nor for aircraft delays, nor for changes in the travel of the client / guests that would occur as a result of such delays. In the event that the airline cancels the flight before the start of the service, the client / guest is entitled to a full refund of the paid price of the service. XVI. USE OF DATA Nika Špika protects all acquired data on subscribers / guests in accordance with the Personal Data Protection Act. Nika Špika processes all acquired data on subscribers / guests in accordance with the Personal Data Protection Policy, available at www.nikaspika.si. XVII. RESPONSIBILITY By paying the bill for the services of Niko Špik, the client confirms and agrees that:

  • is acquainted with the general terms and conditions (published at https://www.nikaspika.si/pravnoobvestilo)
  • is acquainted with the personal data protection policy (published at https://www.nikaspika.si/pravnoobvestilo)
  • accepts responsibility for himself and other participants who attend the service on his initiative.
  • does not disguise the health problems of service participants that would prevent participation in the service
  • in case of problems, the participants will immediately inform the guide / representative
  • is aware of its responsibilities and possible consequences.

​ Nika Špika and persons participating on behalf of the company are in no case liable for: bodily injury to service participants, damage or destruction of equipment and property of participants, damage or destruction of bicycles / SUP / other rented equipment for service performance, damage or destruction car, other damage or destruction that occurs during the provision of services. XVII. FINAL PROVISIONS In the event of a dispute between the parties, the competent court shall apply. ​ Legal notice valid from 1.1.2021.

SPLOŠNI POGOJI POSLOVANJA

Splošni pogoji veljajo od 1.1.2021

  1. SPLOŠNA DOLOČILA

Splošni pogoji so sestavni del pogodbe, ki jo skleneta Nika Špika-Nika Šuligoj S.P. in (v nadaljevanju Nika Špika) in naročnik, ki se prijavlja na storitev v organizaciji Nika Špika. V primeru, da je posamezna določba v programu urejena drugače kot v teh splošnih pogojih, veljajo določbe, navedene v programu. V primeru telefonske prodaje oziroma prodaje preko interneta se šteje, da je naročnik sprejel določila teh splošnih pogojev takrat, ko je telefonsko oziroma preko interneta naročil storitev. Z določili splošnih pogojev se naročnik lahko seznani na spletni strani http://www.nikaspika.si, kjer so posebej označeni in splošno dostopni. Naročnik  oziroma naročnik je vsaka oseba, ki je opravila veljavno rezervacijo ali opravila nakup/plačilo storitev. Ti splošni pogoji ne veljajo za najem avtomobilov in ostale opreme ponudnikov storitev, kjer zastopa Nika Špika kot posrednik. V tem primeru naročnika zavezujejo splošni pogoji ponudnikov in zakonodaja na tem področju.  

  1. PRIJAVA IN POGODBA

Na storitev v organizaciji Nika Špika se naročnik lahko prijavi pri Nika Špika. Program storitev velja kot ponudba. Na osnovi ponudbe se naročnik pisno prijavi na izbrano storitev. Ob prijavi naročnik prejme dokument Nika Špika (avansni račun, ki je pogodba storitev), iz katerega so razvidni vsi podatki o naročeni storitvi. Naročnik je dolžan dokument pregledati in v primeru kakršnegakoli nesoglasja ali napake le-tega reklamirati v roku enega dneva po njegovi izdaji. S plačilom prvega obroka (akontacija) se šteje, da je pogodba sklenjena. Naročnik je dolžan ob prijavi navesti zahtevane podatke in predložiti dokumente, ki jih zahteva program storitev ter izvršiti plačilo v skladu z določbami teh splošnih pogojev. V primeru, da naročnik ob prijavi ne navede pravilnih podatkov, je odgovoren za vse stroške oziroma posledice, nastale zaradi napačnih podatkov. Prijava naročnika je zavezujoča. Od nje lahko odstopi v skladu z določili o odpovedi storitev naročnika. Za zavezujočo prijavo se poleg plačanega 1. obroka. Z izpolnitvijo prijavnice oziroma predložitvijo osebnih podatkov naročnikov se šteje, da je pogodba sklenjena in je naročnik ob morebitni odpovedi storitev dolžan poravnati vse stroške v skladu z določili o odpovedi storitev s strani naročnik a/gosta. Nika Špika je v skladu s pogodbo dolžna naročniku nuditi storitve, ki imajo vsebino in lastnosti, kot so napovedane v pogodbi oziroma programu storitev in skrbeti za pravice in interese naročnik a/gosta v skladu z dobrimi poslovnimi običaji. Naročnik je dolžan skrbeti, da sam osebno, njegove osebne listine in njegova prtljaga izpolnjujejo pogoje, ki so predpisani z obmejnimi, carinskimi, sanitarnimi, denarnimi in drugimi upravnimi predpisi. Nika Špika ima pravico zavrniti prijavo naročnik, za katerega lahko upravičeno vnaprej domneva, da teh pogojev ne izpolnjuje oziroma jih lahko ne bi izpolnjeval tekom izvajanja storitev.   III. PRIJAVNINA IN VARŠČINA Nika Špika za svoje storitve zaračunava naročnik u standardne rezervacijske stroške in stroške za sestavo ponudbe v višini 20% bruto cene ponudbe. Nika Špika lahko za posamezni storitev določi drugačne rezervacijske stroške. V primeru personaliziranih storitev in ponudb lahko Nika Špika zaračuna naročnik u/gostu dodatnih 50,00EUR-100,00EUR v obliki varščine za izdelavo ponudbe:

  • Če naročnik ponudbo sprejme se ti stroški odštejejo od končne cene ponudbe.
  • Če naročnik ne sprejme ponudbe, se varščina ne vrača.

 

  1. PLAČILO

Za dan plačila se šteje dan, ko naročnik izvrši vplačilo neposredno pri Nika Špika, oziroma ko Nika Špika  prejme plačilo na transakcijski račun. Naročnik oziroma skupina ob prijavi plača 20% bruto cene ponudbe – akontacije plačila. Preostali del naročnik plača najmanj 10 dni pred začetkom storitve, v kolikor ni na dokumentu Nika Špika (pogodba, račun) drugače določeno. Pravočasno plačilo pomeni potrjeno rezervacijo. Če naročnik ne plača v dogovorjenem roku, to pomeni odpoved storitev in se smiselno uporabijo določila o odpovedi storitev naročnik a/gosta.   Naročnik se obvezuje vplačati razliko, ki bi nastala zaradi morebitne računske napake na izdanem dokumentu Nika Špika, Nika Špika pa se obvezuje vrniti naročnik u/gostu eventualno preveč zaračunani znesek, ki izvira iz računske napake. Ta obveza velja do izteka poslovnega leta.   Nika Špika lahko v programu določi, da naročnik  plača določene storitve, ki bodo opravljene na kraju samem, njenemu predstavniku (»obvezno doplačilo na kraju samem«). V tem primeru Nika Špika ne nastopa kot organizator niti kot posrednik, ampak zgolj kot informator. V tem primeru uveljavlja naročnik vse reklamacijske zahtevke izključno od izvajalca storitve na kraju samem.  

  1. CENE

Cene storitev so določene s programom ter veljajo od dneva objave programa do spremembe. V ceno so vštete storitve, ki so navedene v programu storitev. Za naročnik a je veljavna cena na dan sklenitve pogodbe/izdaje računa. V skladu z veljavno zakonodajo lahko Nika Špika to ceno spremeni tudi po sklenitvi pogodbe, in sicer zaradi sprememb v menjalnem tečaju ali zaradi sprememb v tarifah prevoznikov, ki vplivajo na ceno storitev. V primeru spremembe cene iz tega naslova Nika Špika o tem najkasneje 2 dni pred odhodom pisno obvesti naročnik a/gosta, ter izda dodatni dokument (račun), ki ga je naročnik  dolžan plačati pred pričetkom storitev. Če zvišanje dogovorjene cene preseže 8 odstotkov cene storitev, lahko potrošnik odstopi od pogodbe, ne da bi moral povrniti škodo. V tem primeru bo Nika Špika naročnik u vrnila vplačani znesek. Prav tako Nika Špika v programu storitev določi izhodiščno ceno pri določenem številu naročnik ov, ki se lahko spremeni, v kolikor se za storitev prijavi manjše število naročnik ov. Nika Špika v programu navede to dodatno ceno v obliki »obveznega doplačila v primeru velikosti skupine od/do oseb«. Ob prijavi Nika Špika naročnik u/gostu zaračuna izhodiščno ceno storitev. V kolikor nastopijo pogoji za spremembo cene iz naslova »manjše skupine«, naročnik ne more odstopiti od pogodbe, saj je bil z njimi seznanjen ob prijavi.  

  1. POSEBNE STORITVE

Posebne storitve so tiste storitve, ki praviloma niso vštete v ceno storitev (posebna prehrana, druga doplačila po želji …) ali pa so za njih v programu predvidena doplačila ( druga doplačila ipd.), zato jih naročnik plača posebej, razen če ni v programu drugače določeno. V primeru, da so k posameznemu storitev razpisane posebne storitve, naročnik posreduje želje po teh storitvah ob prijavi, doplača pa jih k ceni. Objavljene cene posebnih storitev veljajo zgolj v primeru naročila in plačila teh storitev ob prijavi na storitev. Med storitvijo naročnik doplača posebne storitve vodniku ali predstavniku Nika Špika v kraju, kjer se storitev opravlja, če je med storitvijo to še mogoče naročiti, po ceni, veljavni na kraju samem.   VII. NAROČNIKOVA SPREMEMBA POGODBE ALI ODPOVED STORITEV Naročnik ima pravico zahtevati spremembo pogodbe (npr. sprememba imena, dodatne storitve, ipd.) po njeni sklenitvi, Nika Špika pa je dolžna preveriti, če je to sploh mogoče. V primeru spremembe pogodbe na zahtevo naročnik  Nika Špika lahko zaračuna naročnik u administrativne stroške v višini 30,00 EUR za spremembo, v kolikor ni s temi splošnimi pogoji drugače določeno. V primeru, da s spremembo nastanejo dodatni stroški jih je naročnik  dolžan poravnati. Naročnik  ima pravico do odpovedi storitev direktno pri Nika Špika. V primeru, ko naročnik odpove storitev, ima Nika Špika pravico do povračila stroškov, ki so odvisni od časa, ki je ostal do začetka storitve. V vsakem primeru Nika Špika naročniku zaračuna akontacijo v višini 100,00 EUR. Če na programu ni drugače določeno, veljajo spodaj napisani odpovedni stroški: Za enodnevne storitve:

  • odpoved do 30 dni pred začetkom storitve, 10 % cene,
  • odpoved od 29 do 22 dni pred začetkom storitve, 20 % cene,
  • odpoved 21 do 15 dni pred začetkom storitve,, 30 % cene,
  • odpoved 14 do 8 dni pred začetkom storitve, 50 % cene,
  • odpoved 7 dni do na dan začetka storitve, 100 % cene,

Ne glede na zgoraj določene stroške odpovedi so le-ti lahko drugačni, kadar to narekujejo pogoji organiziranja storitev, torej ki jih Nika Špika narekujejo veljavni pogoji prodaje in/ali jih pogojujejo poslovni partnerji. Ne glede na zgoraj določene stroške so stroški odpovedi lahko tudi drugačni, če so navedeni v programu storitev ali pogodbi. Ob odpovedi storitev pred odhodom naročnik poda pisno odpoved oziroma podpiše odpovedni dokument, ki mu ga izda Nika Špika. Če naročnik zavrne podpis ali potrditev tega dokumenta, se šteje, da storitev ni odpovedal. Med storitvijo lahko naročnik prekine storitev na svojo željo. Če naročnik prekine storitev, ob vrnitvi nima pravice do povračila stroškov ali kupnine, ne delno, ne v celoti. V kolikor naročnik med storitvijo po svoji želji spremeni program, ki je sestavni del pogodbe z Nika Špika, se šteje, da je naročnik odstopil od pogodbe med storitvijo. V tem primeru je naročnik odgovoren za stroške in škodo, ki jih je s tem povzročil. V primeru spremembe programa na lastno željo ali zaradi višje sile, ne da bi za to obstajali razlogi na strani Nika Špika zaradi nepravilno opravljene storitve, naročnik nima pravice zahtevati kakršnekoli odškodnine ali znižanja cene. Nika Špika oziroma pooblaščena oseba lahko kadar koli pred storitvijo ali na dan odhoda zavrne osebo, kadar oceni, da bi naročnik lahko ogrozil zdravje ali premoženje sebe ali drugih, oziroma ki je ob odhodu očitno pod vplivom alkohola, drog ali drugih tovrstnih substanc. Nika Špika v tem primeru ravna po določilih o odpovedi naročnika. Nika Špika ima pravico med storitvijo zahtevati od naročnika-gosta, da prekine storitev s skupino, če ne poskrbi za to, da sam osebno, njegove osebne listine in njegova prtljaga izpolnjujejo pogoje, ki so predpisani z obmejnimi, carinskimi, sanitarnimi, denarnimi in drugimi predpisi, ali če je očitno pod vplivom alkohola, drog ali drugih tovrstnih substanc ali če se neprimerno obnaša do ostalih in njegovo izločitev zahteva skupina. Nika Špika v tem primeru ravna po določilih o odpovedi naročnia. Nika Špika bo uveljavljala vso škodo, ki jo je med trajanjem izvajanja storitev povzročil s svojim neustreznim ravnanjem. Višina stroškov odpovedi storitev v primeru, da Nika Špika ni organizator storitve, je določena s splošnimi pogoji ali drugim aktom organizatorja.   VIII. ORGANIZATORJEVA SPREMEMBA PROGRAMA ALI ODPOVED STORITVE Nika Špika si v skladu z veljavno zakonodajo pridržuje pravico do odpovedi storitev, če se na storitev ne prijavi minimalno potrebno število udeležencev, ki je navedeno v programu storitve. Nika Špika naročnika obvesti o odstopu pogodbe, če se ni prijavilo minimalno število udeležencev, najkasneje: – 2 dni (48 ur) pred začetkom storitev, ki traja 1 dan. V primerih, ko Nika Špika izrecno pisno jamči izvajanje, ne more odpovedati storitve, razen če se prijavi manj kot v programu predvideno najmanjše število udeležencev storitve. Nika Špika si pridržuje pravico do popolnega ali delnega odstopa od pogodbe, če pred izvajanjem ali med izvajanjem programa nastopijo izredne okoliščine, ki jih ni bilo mogoče pričakovati, odstraniti ali se jim izogniti, za Nika Špika pa te okoliščine pomenijo utemeljen razlog, da pogodbe ne bi sklenila, če bi obstajale ob sklenitvi pogodbe. Nika Špika lahko odpove pogodbo oziroma odstopi od pogodbe in zahteva povrnitev škode od naročnika, ki neposredno krši določbe pogodbe, ki jo je sklenil z Nika Špika, predvsem če se ugotovi, da je naročnik namerno sporočil napačne podatke o številu udeležencev ali njihovi starosti, oziroma je med storitvijo prišlo do sprememb, naročnik pa o tem ni obvestil Nika Špika. Nika Špika si pridržuje pravico (in ne odgovarja) za spremembe dneva in časa odhoda oziroma za odpovedi storitve zaradi nastopa višje sile ter pravico do spremembe storitve, če se spremenijo pogoji za storitev (nov vozni red, negotov položaj v državi, kjer je organiziran storitev, naravne nesreče ali drugi nepredvideni vzroki, na katere Nika Špika ne more vplivati), brez posebne odškodnine in po veljavnih predpisih v potniškem prometu. Odgovornost Nika Špika je omejena zgolj na ne izvedbo določenega dela programa, v delu, ki pomeni ustrezne materialne stroške. Nika Špika ne odgovarja za nematerialno škodo, ki bi nastala iz naslova zamud, odpovedi ali spremembe prevoza ali prevoznega sredstva. Nika Špika ne more prevzeti odgovornosti za spremembe programa zaradi nastopa kakršnekoli višje sile med potekom programa. V teh primerih lahko naročniku zagotovi storitve v spremenjeni obliki, glede na obstoječe možnosti. V primeru, da Nika Špika odpove storitev, ima naročnik pravico do celotnega povračila vplačane cene, nima pa pravice do povračila stroškov, ki so bili s programom zahtevani. O kakršnikoli naknadni spremembi programa Nika Špika naročnika nemudoma obvesti.  

  1. POTNI DOKUMENTI

Naročnik mora imeti veljaven potni list ali drug veljaven dokument, s katerim lahko vstopi v državo. Naročnik je dolžan paziti na vsa določila glede veljavnosti potovalnega dokumenta. Veljavnost dokumenta se upošteva na ZADNJI dan storitev! Nika Špika za morebitne neprijetnosti ali prisilno prekinitev storitev za udeležence storitev iz tega naslova ne odgovarja. Naročnik je dolžan pridobiti vizume, ki so za državo zahtevani. Če naročnik te obveznosti ne izpolni, Nika Špika ravna po določilih o odpovedi storitev s stani naročnika. V primeru zavrnitve vstopa v državo ali druge ovire nosi vse stroške naročnik sam. Zaradi zahtev v mednarodnem potniškem prometu (letalski, ladijski, avtobusni …) je naročnik dolžan ob prijavi posredovati vse potrebne podatke o vseh udeležencih, ki jih prijavlja. Podatki se morajo v celoti ujemati s podatki v uradnih dokumentih, ki so jih udeleženci storitev v skladu s predpisi o prestopu državne meje in ustreznimi tujimi zakonodajnimi akti nositi s seboj. V primeru, da napačni podatki povzročijo zamudo, dodatne stroške ali prekinitev storitev drugim udeležencem, odgovarja za vse nastale stroške udeležencem naročnik sam. Če naročnik med storitvijo izgubi dokumente ali so mu le-ti ukradeni, so pa nujno potrebni za nadaljevanje storitve ali za vrnitev v domovino, si naročnik na lastne stroške priskrbi nove. V primeru, da mora naročnik zaradi izgube ali kraje dokumentov prekiniti storitev, ni upravičen do kakršnegakoli povračila vplačane cene storitev ali do povrnitve stroškov.  

  1. ZDRAVSTVENI PREDPISI

Nika Špika ne odgovarja za morebitne zaplete ali prekinitev storitev s strani naročnika zaradi nespoštovanja zdravstvenih predpisov države, v katero vstopa, kakor tudi ne za stroške povezane s tem.  

  1. CARINSKI IN DEVIZNI PREDPISI

Naročnik je dolžan spoštovati vse carinske in devizne predpise Republike Slovenije, kakor tudi predpise vseh drugih držav storitve. Če zaradi nespoštovanja predpisov naročnik ne bi mogel nadaljevati, sam nosi vse posledice in stroške, ki nastanejo v zvezi s tem njemu in vsem drugim udeležencem storitve.   XII. PRTLJAGA Nika Špika ne odgovarja za prevoz, krajo ali poškodovanje prtljage udeležencev ali drugih osebnih stvari, dragocenosti in dokumentov iz namestitvenih objektov (hotelskih sob, apartmajev ipd.) in prevoznih sredstev (letal, avtobusov, ladij ipd.). Prijavo izgubljene ali poškodovane prtljage udeleženec sam naslovi na prevoznika ali hotel. Prevoz posebne prtljage (kot so kolo, surf, golf oprema, smuči, glasbeni inštrumenti ipd.) mora naročnik najaviti že ob prijavi ter plačati prevozniku v skladu s pravili prevoznika, v kolikor v programu storitev ni drugače določeno. Vse stroške oziroma škodo, ki bi zaradi tega nastala, nosi naročnik sam. Pri prevozu ima naročnik pravico do brezplačnega prevoza določene teže prtljage (po določilih prevoznika), vsak dodatni kilogram pa doplača naročnik sam na kraju samem v ustrezni valuti oziroma po določilih prevoznika.   XIII. INFORMACIJE Informacije, ki jih  naročnik dobi ne obvezujejo Nika Špika bolj kot navedbe v programu ali ponudbi. V primeru dvoma se vedno šteje za veljavno pisna ponudba, račun in pogodba, pisna informacija ali pisna razlaga.   XIV. REKLAMACIJE OZIROMA PRITOŽBE Naročnik je dolžan nepravilnosti sporočiti predstavniku Nika Špika na kraju samem, ko se zgodijo. V primeru, da bi bila reklamacija lahko rešena na kraju samem (na primer slabo pripravljena jed), naročnik pa ni sporočil napake oz. nepravilnosti predstavniku Nika Špika, se šteje, da se je naročnik strinjal s tako storitvijo in s tem je izgubil pravico do vlaganja kasnejših reklamacij. Naročnik lahko vloži pisno reklamacijo v roku enega mesecev od dneva, ko je bila storitev nepravilno opravljena, sicer Nika Špika le-te vsebinsko ne obravnava. Reklamacija mora biti utemeljena. Naročnik naj zato reklamaciji priloži ustrezne dokaze in/ali ustrezno potrdilo naročnika, gostinca, prevoznika oziroma druge ustrezne osebe o dejanskem stanju, na podlagi katerega naročnik uveljavlja svoj zahtevek. Nika Špika je dolžna pisno odgovoriti na reklamacijo v 8 dneh po njenem prejemu. Če gre za enostavno pomanjkljivost in napaka ni sporna (oziroma če naročnik ni priložil vseh potrebnih dokumentov v roku, potrebnem za njihovo pridobitev) je Nika Špika dolžna po prejemu popolnega reklamacijskega zahtevka zahtevi ugoditi. Če napaka ni enostavna, je Nika Špika dolžna raziskati vse okoliščine, ki so pripeljale do reklamacije. Dokler Nika Špika ne odloči o pritožbi, se naročnik odreče posredovanju katerekoli druge osebe, sodnih ustanov ali dajanja informacij javnim glasilom. Višina odškodnine je omejena z višino cene vplačanega storitve oziroma z višino realne vrednosti neizvedenih storitev. To določilo ne velja v primeru, ko ima Nika Špika pravico do odpovedi storitev ali spremembe programa, skladno z določili teh splošnih pogojev in zakona. Ne glede na vloženo reklamacijo je naročnik dolžan poravnati svoje obveznosti po izdanih računih za opravljeno storitev v skladu z razporedom plačil, morebitna odškodnina pa se izplača po končanem reklamacijskem postopku na osebni račun naročnik /gosta.  

  1. ODGOVORNOST ZA TOČNOST LETALSKIH PREVOZNIKOV

Nika Špika ne odgovarja za točnost letalskih prevozov na rednih ali izrednih poletih in tudi ne za zamude letal kakor tudi ne za spremembe potovanja naročnikov, ki bi nastale kot posledica takšnih zamud. V primeru, da letalska družba odpove let še pred pričetkom storitve, ima naročnik pravico do celotnega povračila vplačane cene storitve.   XVI. UPORABA PODATKOV Nika Špika vse pridobljene podatke o naročnikih varuje v skladu z Zakonom o varstvu osebnih podatkov. Nika Špika vse pridobljene podatke o naročnikih obdeluje skladno s Politiko varstva osebnih podatkov, dostopno na www.nikaspika.si.   XVII. ODGOVONOST Z plačilom računa storitev Nika Špika S.P. naročnik: – sprejema pogoje varstva osebnih podatkov – sprejema odgovornost za udeležene na storitvi ter imetje – ne skriva zdravstvenih težav, ki bi lahko preprečila sodelovanje udeležencev na storitvi – v primeru, če se pojavijo težave bo le te sporočila predstavniku – se zaveda odgovornosti in možnih posledic udeležbe na storitvah Nika Špika SP in ostale osebe, ki sodelujejo s podjetjem nikakor ne odgovarjajo za: telesne poškodbe, poškodbo opreme in imetja posameznika, poškodbo sposojene opreme SUP/ kolo / ostala oprema za izvedbo izleta/aktivnosti, vozila, ostalih poškodbo med storitvijo…   XVIII. KONČNA DOLOČILA V primeru spora med strankami se uporabi pristojno sodišče.
